What is probate and how does it work?
Probate is a court supervised procedure to administrate the estate of a deceased person. A probate case is opened whether the deceased person had a will or died without a will. When the deceased dies without a will, they are said to have died intestate and their property is distributed according to State statutes. Any interested party may open a probate estate, but usually it is a close relative or a creditor that will initiate the proceedings. Once the probate case is opened, the court will appoint someone to administrate the estate by issuing letters of appointment as a personal representative.
